Kratom caused the death of a thirty-nine-year-old American woman, family receives more than $11 million in compensation!
The family of a Florida woman who died in 2021 after ingesting kratom has received more than $11 million from the distributor of an herbal extract from Southeast Asia that has an opioid-like effect on the brain. During a hearing last Thursday (7/27/2023), Judge Donald Middlebrooks of the federal court in West Palm Beach, Florida, ordered the company operating as Kratom Distro to pay compensation to the four surviving children of Krystal Talavera, who died after ingesting kratom.
What is kratom and why is it used in fitness?
Kratom is the leaf of the Mitragyna speciosa tree, which is found naturally in Southeast Asia. Kratom has been used for centuries as a medicinal plant and in recent years has become popular in the western world as well. Kratom contains a number of alkaloids, the most well-known of which is mitragynine. Mitragynine has similar effects to opiates but is considered less addictive. Kratom is used to treat pain, anxiety, depression, and other ailments. However, Kratom is also associated with a number of side effects such as nausea, vomiting, diarrhea, and dizziness. Kratom can also be addictive and can lead to withdrawal symptoms such as anxiety, restlessness, and insomnia. If you are considering taking kratom, it is important to talk to your doctor about the potential risks and benefits.
Kratom is used in fitness because of its purported effects on increasing energy, reducing pain, and improving performance. However, Kratom is not FDA approved for any medical purpose and can have a number of side effects, including nausea, vomiting, diarrhea, dizziness, anxiety, depression, and insomnia. Kratom can also be addictive and can lead to withdrawal symptoms. If you are considering taking kratom, it is important to talk to your doctor about the potential risks and benefits.

Judge Middlebrooks emphasized that money cannot fully compensate for the pain and suffering that children experience after losing their mother, but he also acknowledged that the defendant must be held accountable and pay compensation.
Krystal Talavera's son, Devin Filipelli, expressed hope that the court's decision will draw attention to what he considers "the dangers of kratom." The owner of Kratom Distro, Sean Michael Harder, declined to comment on the ruling.
Kratom, made from the leaves of the evergreen tree, came under strict restriction by the US Drug Enforcement Agency in 2016, but the ban was later lifted due to strong public opposition. Still, the U.S. Food and Drug Administration has warned consumers about the potential safety and addiction risks associated with kratom.
After ingesting kratom ordered from Kratom Distro, Krystal Talavera was found unconscious and later pronounced dead. An autopsy revealed that the cause of death was acute intoxication from mitragynine, the main ingredient in kratom, which has opioid-like effects.
Filipelli filed a lawsuit against Kratom Distro over his mother's death, and lawyers for the family said the court's decision should highlight the safety risks associated with kratom use. The law firm that represented the Talavera family also recently obtained a $2.5 million verdict over a Washington state kratom manufacturer in another wrongful death lawsuit.
Michael Cowgill, an attorney with the firm, urged government officials to take action to protect other families from the risk of needless deaths from kratom overdoses.
